Participants consent to all the clauses set forth below in participating in the online yoga class offered by VANAKKAM YOGA SCHOOL LIMITED (hereinafter referred to as “VYS”).
1. Participants’ environment and other circumstances
(1) Participants acknowledge in advance that they may have difficulties in participating in the online class depending on their environment (computer hardware specifications, software conditions, network environment, etc.).
(2) Participants are required to prepare their environment, which enable them to participate in the online class, at their own responsibility and expense.
(3) Participants acknowledge in advance that VYS shall not bear any responsibility even if there are issues with all or part of the audio-visual contents of the online class due to their environment.
(4) Participants acknowledge in advance that they shall be responsible for their own injury, illness, or accident that occurs during the online class, regardless of its cause, and that VYS shall not bear any responsibility.
(5) Participants must turn on their camera during the online to ensure that VYS ascertain the attendance of them; Participants acknowledge in advance that VYS may dismiss them from the online class if it is impossible for VYS to ascertain it.
(6) Participants acknowledge in advance that all or part of the video and sound contents of the online class may be recorded by VYS.
(7) Participants acknowledge in advance that they may appear in screen-captures or videos of the online class to be shot by VYS-related persons (including, but not limited to, yoga teachers, translators, and demonstrators; hereinafter, “VYS-related members”) and that the screen-captures or videos may be used in various media in relation to VYS, or in SNS including Facebook and the like for notifications or promotions of VYS.
(8) Participants acknowledge in advance that they can use only one device per person in the online class and that, if participants join the online class with two or more devices, additional fees may be charged in accordance with the number of devices.
2. Intellectual Property Rights
(1) Participants acknowledge that all the intellectual property rights existing in the information (including, but not limited to, text, screen and audio capture, sound and visual recordings, etc.) provided by VYS through the online class (hereinafter referred to as "VYS's intellectual property rights") shall belong to VYS.
(2) Participants acknowledge in advance that they are prohibited from using (including, but not limited to, replicating, distributing, assigning, automatically transmitting, etc.; hereinafter, referred
to as “using”) VYS’s intellectual property rights for any purpose other than for the online class; However, participants may post screen captures to their blog or SNS including Facebook and the like as long as they observe Article 3.
(3) Participants acknowledge that using VYS’s intellectual property rights by a third party is prohibited in any manner.
3. Prohibited matters
Participants shall not perform any of the acts stated below for any reason and shall be responsible, to the extent reasonable, for compensating damages incurred by VYS.
1. Acts which violate or threaten to violate VYS’s intellectual property rights
2. Acts of recording audio, taking a screenshot, or recording video during the online class without consent of VYS.
3. Acts of collecting and disclosing information about other participants in the online class in an unlawful manner.
4. Acts of directly or indirectly sharing the online class, without permission of VYS, with a third party who is not a participant.
5. Acts which injure or threaten to injure the reputation of VYS, VYS-related members or other participants.
6. Acts of disclosing this consent letter to a third party and leading a third party into using this consent letter.
