Membership Terms and Conditions
VANAKKAM YOGA SCHOOL LIMITED (hereinafter referred to as "the Company") establishes the following Terms and Conditions regarding the use of "the Website" (as defined in Article 1) operated by the Company.
Article 1 (Definitions)
In these terms, the following terms are used with the meanings ascribed to them in the following sections:
•"The Website" refers to the system operated on the internet by the Company based on these terms, which provides information on the products or services offered by the Company and has a function to provide those products or services via online.
•"User(s)" refers to any person who accesses "the Website."
•"The Service" refers to the services provided by the Company to Users of the Website under the Terms and Conditions, of which the content and types are subject to change, increase, or decrease at any time at the sole discretion of the Company, with notification provided on the Website or through other means of communication.
Article 2 (Scope and Modification of Terms and Conditions)
1.The Membership Terms and Conditions shall apply to both the Company and Users regarding the use of the Service, and Users shall faithfully comply with the Membership Terms and Conditions when using the Website.
2.Individual terms or additional provisions specified separately by the Company or notified to Users shall form part of these terms.
3.In the event of any discrepancies between these terms and individual or additional provisions, the latter shall prevail.
4.The Company may change these terms without User's consent, and the conditions for using the Service shall be based on the revised terms.
5.Changes to the terms will take effect when notified via email or posted on the Website.
6.The Company shall not be liable for any disadvantage or damage to Users resulting from changes to the terms.
Article 3 (User Status and Restrictions)
1.User Status: Users are deemed to agree to all the Membership Terms and Conditions and all regulations displayed on the Website (including but not limited to Application and Cancellation Regulations) once Users enjoy any part of the Service (including browsing information).
2.Restrictions on Users: Users are prohibited from:
o Using the Website in a manner not prescribed by the Company.
o Impersonating others while using the Service.
o Linking data related to the Service to other data without the Company’s approval.
o Accessing or destroying data stored in computers used for the Website without authorization.
o Interfering with the operation of the Service.
o Engaging in business activities using the Service or using the Service for profit unless separately approved by the Company.
o Collecting or attempting to collect personal information of other Users.
o Engaging in activities contrary to public order or violating domestic or international laws.
Article 4 (Suspension or Interruption of Service)
1.The Company may suspend or interrupt part or all of the Service without prior notice in the following cases:
o Periodic or emergency maintenance of devices or systems for the Service.
o If the Service cannot be provided due to force majeure such as fire, power outage, or natural disaster.
o If a first-class telecommunications carrier ceases to provide its services.
o If the Company deems it necessary for operational or technical reasons, or due to unforeseen circumstances.
2. The Company shall not be liable for any damages or losses caused by suspension or interruption of the Service, regardless of the reason.
Article 5 (Handling of Links)
1. If links to other sites are provided by the Company or a third party, the Company assumes no responsibility for these external sites.
2. The Company is not liable for damages caused by content, advertisements, products, or services on linked external sites.
Article 6 (Copyright)
1. Users may not use any information provided through the Service beyond the scope of private use stipulated by copyright law without the Company’s consent.
2. Users may not allow third parties to use or disclose such information without the Company’s consent.
3. In case of violation of this provision, Users must resolve any issues at their own expense and responsibility and must not cause inconvenience or damage to the Company.
Article 7 (Liability for Damages)
1. The Company shall not be liable for any damages to Users or third parties related to delays, changes, suspensions, or termination of the Service, or loss or leakage of provided information.
2. If a User causes damages to a third party through the use of the Service, such User shall resolve the matter at his/hers own expense and responsibility without causing harm to the Company.
3. If a User violates these terms or engages in illegal activities, the Company reserves the right to claim appropriate compensation.
Article 8 (Privacy Policy)
The handling of personal information obtained through the Service will be governed by the Company’s separate privacy policy.
Article 9 (Governing Law)
These terms are governed by the laws of Japan.
Article 10 (Jurisdiction)
In case of disputes regarding these terms, the district court with jurisdiction over the location of the Company's headquarters shall be the exclusive court of first instance.
Application and Cancellation Regulations
Participants (hereinafter referred to as "Participants") in workshops provided by VANAKKAM YOGA SCHOOL LIMITED, which operates VANAKKAM YOGA SCHOOL (hereinafter referred to as "the School"), are considered to have agreed to the following terms and conditions regarding application and cancellation:
1. Application:
(1) Participants must complete the membership registration prescribed by the Website when applying for workshops offered by the School, regardless of whether they use the Website or not.
(2) Participants agree to the content displayed on the Website, including these regulations, the Membership Terms and Conditions, Regulations on Participation in Online Classes, and Regulations on Participation in On-Site Classes, at the time of registration.
2. Completion of Application and Cancellation:
For general workshops
(1) The application is complete after the payment has been confirmed.
(2) Applications will be closed once the number of participants reaches the limit.
(3) Refunds due to cancellation: (i) If the cancellation is made after the specified deadline for personal reasons, refunds will not be possible. (ii) The deadline for cancellations varies by workshop. (iii) For non-cancellable courses, if a cancellation is made due to a mistake in the payment process, a cancellation fee of 10% of the payment amount will be charged.
(4) Participants confirm that they have checked the cancellation deadline of the relevant workshop in the workshop information displayed on the website and have no objections.
For teacher training, continuing education, and exclusive intensive courses
(1) Approval by Master Sudhakar is required, and it may take several days for the School to send the notice email.
(2) The application is complete after the payment has been confirmed.
(3) Regardless of using the Website or not, no cancellations can be made after the application, and the reservation fee is non-refundable.
(4) If the number of participants does not meet the minimum required, the workshop may be canceled.
Regulations on Participation in Online Classes
Participants (hereinafter referred to as "Participants") in online workshops (hereinafter referred to as "Online Classes") provided by VANAKKAM YOGA SCHOOL LIMITED, which operates VANAKKAM YOGA SCHOOL (hereinafter referred to as "the School"), are considered to have agreed to the following terms and conditions:
1. Usage Environment and Others:
(1) Participants acknowledge that depending on their environment (PC hardware specifications, software conditions, network environment, etc.), there may be obstacles to participating in Online Classes.
(2) Participants are responsible for preparing the necessary environment for participating in Online Classes at their own expense and responsibility.
(3) If participants have difficulty viewing all or part of the Online Classes due to their environment, the School is not responsible.
(4) Participants acknowledge that they are responsible for any injuries, illnesses, or accidents during Online Classes, and the School will not be held responsible, regardless of the cause.
(5) Participants are required to keep their cameras on during Online Classes so that the School can verify their participation. If the School cannot verify participation, participants may be forced to leave the class.
(6) Participants acknowledge that the content of Online Classes (including video and audio) may be recorded by the School.
(7) Participants acknowledge that they may appear in photos or videos taken by the School's affiliates (such as instructors or demonstrators) during Online Classes, which may be used in various media or SNS (e.g., Facebook) for announcements or promotions.
(8) Participants acknowledge that they may use only one device per person during Online Classes. If they access with more than one device, they will be charged additional participation fees accordingly.
2. Intellectual Property Rights:
(1) Participants acknowledge that the intellectual property rights of the information provided through Online Classes (including text, video, and audio recordings) belong to the School.
(2) Participants may not use the School’s intellectual property outside of Online Classes, except with prior consent for publishing screenshots on personal blogs or SNS.
(3) Participants may not allow third parties to use the School's intellectual property.
3. Prohibited Actions:
Participants agree not to engage in the following actions and will be responsible for compensating the School for any damages resulting from violations:
1. Any act that infringe on the School’s intellectual property rights.
2. The act of recording audio or taking photos or videos during Online Classes without the School's consent.
3. The act of unlawfully collecting and disclosing information held by other participants
4. The act of sharing Online Classes with third parties, who are not participants, whether directly or indirectly, without the school's permission
5. Any act that damages or may damage the interests or reputation of the School, its affiliates (including but not limited to instructors, interpreters, demonstrators, etc.), or other participants.
Regulations on Participation in On-Site Classes
Participants (hereinafter referred to as "Participants") in on-site workshops (hereinafter referred to as "On-Site Classes") provided by VANAKKAM YOGA SCHOOL LIMITED, which operates VANAKKAM YOGA SCHOOL (hereinafter referred to as "the School"), are considered to have agreed to the following terms and conditions:
1. Injury, Health Condition, and Others:
(1) Participants acknowledge that they are responsible for any injuries, illnesses, accidents, or infections that occur during On-Site Classes, and the School is not liable, regardless of the cause.
(2) Participants must report the following to the School before the start of On-Site Classes:
i. Any pre-existing conditions, injuries, pain, or illnesses, or if they are under medical treatment.
ii. Any symptoms of illness (e.g., fever or respiratory issues) before the start of On-Site Classes.
iii. Pregnancy.
(3) Participants acknowledge that they are responsible for their personal belongings during On-Site Classes, including theft, loss, or damage.
(4) Participants acknowledge that they are responsible for any accidents encountered during transportation to and from On-Site Classes.
(5) Participants acknowledge that they may appear in photos or videos taken by the School's affiliates during workshops, which may be used in various media or SNS for announcements or promotions.
2. Intellectual Property Rights:
(1) Participants acknowledge that the intellectual property rights of the information provided through On-Site Classes belong to the School.
(2) Participants may not use the School’s intellectual property outside of On-Site Classes.
(3) Participants may not allow third parties to use the School's intellectual property.
3. Prohibited Actions:
Participants agree not to engage in the following actions and will be responsible for compensating the School for any damages resulting from violations:
1. Any act that infringe on the School’s intellectual property rights.
2. The act of recording audio or taking photos or videos during On-site Classes without the School's consent.
3. The act of publicly sharing photos or videos taken with the School's consent to an unspecified number of people for personal profit.
4. Any act that damages or may damage the interests or reputation of the School, its affiliates (including but not limited to instructors, interpreters, demonstrators, etc.), or other participants.
